Decree Debent by Boniface [VIII], pope, that the custom of single visitation claimed by the prior and chapter of Durham against A[ntony Bek], bishop of Durham, is contrary to the common good and unreasonable, as it tends to restrict discovery of the truth; that it had been decreed by a general council that a notary or two suitable persons should be present to record proceedings; that monks are debarred by their profession from appearing in any legal actions except cases of heresy nor are they suitable persons to act as notaries in the matter of correcting their own faults: that it detractsfrom the bishop's dignity to visit alone persons who are possibly suspect; that in order to prevent the bishop from becoming oppressive, he must visit henceforth accompanied by two or three clerks of whom at least one must be a member of the Benedictine order, and by one notary, any custom or agreement to the contrary notwithstanding.

Decree by Boniface [IX], pope, that the death of Thomas [of Hatfield], bishop of Durham, has frustrated the bishop's plan, as explained by the prior and convent of Durham to Urban VI, late pope, for the foundation of a college at Oxford for 16 persons, of whom 8 would be monks of Durham and 8 secular clerks, all selected by the prior and chapter, who would study theology and arts; that Richard [II], king of England, being anxious that this plan should be fulfilled, granted the patronage of the churches of Frampton, Bossall, Ruddington and Fishlake, in the dioceses of Lincoln and York, which belonged to the crown, for the endowment of the college; that Urban VI had granted, by mandate to the late bishop of Durham that these churches might be appropriated to the college, which has taken place; that the prior and chapter of Durham have since deputed one of the 8 monks living at the college as prior there; that the archbishop of York and the bishop of Lincoln shall no longer require the prior of the college to appear in person at their synods, on the occasion of visitations or convocations, but that he may send proctors in his place.

Declaration by John [XXIII], pope, in response to a petition by the prior and chapter of Durham, confirming the final sentence of the commissary of Henry [Bowet], archbishop of York, in a case between the archbishop and the prior and chapter concerning their title to certain churches in the diocese of York appropriated to Durham priory and Durham College Oxford, and further confirming that this sentence shall have full legal force in any future disputes, so that the prior and chapter need not produce their original deeds, which may be harmed by repeated travelling, and reciting in full the final sentence in the archbishop's court at York (ff.23r-27r: 3.2.Archiep.1, omitting the last 2 notarial eschatocols).

Indult by Eugenius [IV], pope, to the prior and monks of Durham, that each monk's chosen confessor may grant him full remission on his death-bed of all sins which he has repented and has confessed, but that if the confessor has already enjoined him to make satisfaction, this must be performed; that if confidence of such remission leads to the commission of more sins, no such remission should be granted; that for one year from the receipt of this indult they must fast weekly on Fridays or, if they are already bound to fast then by precept of the church, by their Rule or by penance or vow, then on some other day weekly, and that if they cannot complete this in one year they must do so in the next; that if they cannot fulfil such fast, their confessor must substitute other works of piety, or this indult will be void.

Declaration by Eugenius [IV], pope, that the prior and subprior of Durham and their successors shall have power to grant dispensations, the prior to all monks of the church and its cells, the subprior to the prior, for all additional statutes, mandates and punishments not of the substance of the Rule, and similarly to absolve from all sentences of excommunication incurred in such matters and to enjoin a suitable penance and to grant dispensations to any who have incurred such sentences by celebrating or attending masses celebrated not on contempt of the keys, the constitutions of the legates Otto and Ottobuono and of provincial councils and synods on all these matters notwithstanding.

Grant by Walter [Kirkham] bishop of Durham, to Hugh [of Darlington] prior and the convent of Durham, of licence to enclose their wood in their vill of Muggleswick, with the adjacent land, and to make there a free park, without deer-leap, having the following boundaries: from Flaynardsburg westward until opposite the church, then north to the manor of the prior and convent, then westward to the high road called Balyofgate and from there northward to Thorald's Bridge and along the river Derwent eastward to Flaynards-burg; no-one is to enter the park to hunt or capture any beast without licence from the prior.
