Title: Lancashire-Ushaw Papers
Dates of creation: 1794 - [mid 20th century]
Extent: 6 boxes
Held by: Ushaw College Library
Language: English and Latin
In the early nineteenth century, Lancashire was originally under the control of the vicar apostolic of the Northern District and, following the creation of extra districts in 1840, the Lancashire District. The restoration of the Catholic
hierarchy in 1850 saw the creation of the diocese of Liverpool, comprising the hundreds of West Derby, Leyland, Lonsdale, and Armounderness in Lancashire, as well as the Isle of Man. The Liverpool diocese was later elevated to an archdiocese in
1911.
The relationship between Lancashire and Ushaw College was a particularly fractious one throughout the nineteenth century. Lancashire, as part of the Northern District, had contributed greatly financially towards the building of the college in
1808 and was a constant source of supply in the provision of students for the seminary. However, the Liverpool bishops, notably George Brown and Alexander Goss, felt that their influence in college affairs was marginal and both launched personal
crusades against Ushaw in an attempt to place limitations on its control over college funds. The catalyst for this was the Sherburne-Heatley trial. Squire William Heatley of Brindle Lodge had bequeathed most of his estate to the Rev Thomas Sherburne
of Kirkham, Lancashire, for charitable purposes. From this inheritance, Sherburne handed to Mgr Charles Newsham, president of Ushaw College, the sum of £14,952 which was utilised in Newsham's ambitious building programme. However, Heatley's will
(and, consequently, Sherburne's donation to Ushaw) became a source of dispute. A long and protracted court case followed, with the court eventually ruling against Sherburne. It was alleged that the money donated to Ushaw should have been employed in
Lancashire, so the issue brought to the fore the question of Ushaw's control of trust funds. In 1859, Bishop Goss petitioned over the matter to the Holy See and a commission of inquiry was set up to investigate the administration of Ushaw funds
generally. Thereafter, the bishops of Liverpool and the other northern dioceses effectively gained control over the seminary's finances and it subsequently lost much of the independence spirit inherited from the English College in Douai.
Papers and correspondence between Lancashire and Ushaw College, mostly on financial and administrative issues. As well as correspondence on the subject of the Lancashire students at the college, the papers are particularly valuable for shedding
light on the stormy relationship between Ushaw and Lancashire/Liverpool, notably: the Sherburne-Heatley trust fund dispute and subsequent commission of inquiry into the administration of Ushaw funds; the attempts to establish alternative diocesan
seminaries; and a dispute over the retention of Lancashire students as teaching staff at the college. There are also yearly account and fund statements, as well as reports, affidavits, and legal opinions.
Agreement with the archdiocese of Liverpool for the papers to remain at Ushaw College on a permanent loan basis (December 1972). These papers were originally on loan to Fr David Milburn to assist him in the completion of
History of Ushaw College.
